Terms & Conditions – Blackout Frequency

These Terms & Conditions (“Terms”) govern the use of the Blackout Frequency website, ticket purchases, event attendance, merchandise purchases, and related services operated by Blackout Frequency (“we”, “our”, or “us”).

By accessing our website, purchasing tickets, attending events, or engaging with our services, you agree to these Terms.

1. General

Blackout Frequency operates music events, community gatherings, merchandise sales, and related creative projects primarily within Australia.

We reserve the right to update, modify, or remove content, services, event details, or these Terms at any time without prior notice.

2. Event Entry Conditions

Entry to Blackout Frequency events is subject to:

  • Valid ticket purchase

  • Compliance with venue rules and event staff directions

  • Compliance with applicable laws and safety requirements

Most events are strictly 18+ unless stated otherwise. Valid government-issued photo identification may be required upon entry.

We reserve the right to refuse entry or remove attendees for reasons including but not limited to:

  • Aggressive or unsafe behaviour

  • Harassment or discrimination

  • Intoxication

  • Possession of prohibited items

  • Damage to property

  • Failure to comply with security or venue staff directions

No refunds will be provided to patrons refused entry or removed due to breaches of these Terms.

3. Tickets & Refunds

Tickets are generally sold through third-party ticketing providers such as Humanitix.

All ticket sales are subject to the terms and conditions of the ticketing provider in addition to these Terms.

Unless required by Australian Consumer Law:

  • Tickets are non-refundable

  • Lineups, set times, venues, and event details may change without notice

  • Refunds are not provided for change of mind or inability to attend

If an event is cancelled by Blackout Frequency, ticket holders will be informed regarding refund or rescheduling options.

4. Event Changes

Blackout Frequency reserves the right to:

  • Change venues

  • Modify event times

  • Alter artist lineups

  • Adjust capacity limits

  • Cancel or postpone events due to safety, operational, legal, weather, or unforeseen circumstances

We are not responsible for additional costs incurred by attendees, including travel or accommodation expenses.

5. Photography & Media

By attending a Blackout Frequency event, you acknowledge and agree that:

  • Photography, videography, and audio recordings may occur during events

  • Your image or likeness may appear in promotional content, social media, recap videos, livestreams, or future marketing material

If you have concerns regarding media usage, you may contact event staff or reach out to us directly.

6. Merchandise

All merchandise sales are subject to product availability.

We reserve the right to:

  • Modify pricing

  • Discontinue products

  • Refuse or cancel orders where necessary

Where applicable, Australian Consumer Law rights relating to faulty or damaged goods remain unaffected.

7. Website Usage

Users of the Blackout Frequency website agree not to:

  • Attempt unauthorized access to systems or data

  • Use the website for unlawful purposes

  • Copy or reproduce content without permission

  • Upload malicious software or harmful material

All branding, logos, artwork, promotional materials, and original content remain the intellectual property of Blackout Frequency or their respective creators unless otherwise stated.

8. Third-Party Links & Services

Our website or social media pages may contain links to third-party platforms including ticketing providers, social media services, or external websites.

Blackout Frequency is not responsible for the content, policies, or practices of third-party services.\

9. Liability

Attendees participate in events at their own risk.

To the maximum extent permitted by law, Blackout Frequency, its staff, contractors, collaborators, and venues are not liable for:

  • Personal injury

  • Loss or theft of personal belongings

  • Property damage

  • Delays or disruptions

  • Indirect or consequential losses arising from attendance or website usage

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.

10. Privacy

Your use of our services is also governed by our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising in relation to these Terms will be subject to the jurisdiction of Victorian courts.
